2. Responsibility for content

The content of this website has been compiled with care. Menu descriptions, prices and opening hours are reviewed regularly, but we cannot guarantee that every detail is current at the moment you read it. Seasonal dishes, in particular, change more frequently than this website is updated, and the daily lunch offer may differ from the published plan where supply requires it.

Where prices are stated, they are given in euros and include value added tax at the applicable rate. Prices shown on this website are indicative. The prices displayed on the menu presented in the restaurant at the time of your visit are the ones that apply to your order. Where a discrepancy exists between this website and the printed menu, the printed menu prevails.

Photographs of dishes are illustrative. The presentation, portion size and garnish of a dish as served may differ from the images shown here. Where a photograph shows a dish plated for two people, this is indicated in the caption.

2. Liability

To the extent permitted by Austrian law, Kimchi & Rice GmbH accepts no liability for any direct or indirect damage arising from access to, use of, or inability to use this website, or from misuse of the connection or from technical faults. This exclusion covers damage of any kind, including loss of data, loss of profit and consequential loss, however caused.

We reserve the right to alter, supplement or delete any part of this website, or to withdraw publication of the site in whole or in part, at any time and without prior notice. We do not undertake to keep the site available without interruption.

Written consent from the rights holder must be obtained in advance for the reproduction of any element, whether in whole or in part.

Reproduction for private, non-commercial use is permitted provided that the source is acknowledged and that no alteration is made to the material reproduced. Any commercial use, including reproduction in printed guides, aggregator listings or delivery platforms, requires prior written permission.

5. Privacy statement

We take the protection of your personal data seriously and process it in accordance with the Austrian Data Protection Act (DSG) and, where applicable, the General Data Protection Regulation (GDPR). This section explains what data we collect, why we collect it, and how long we keep it.

Reservation data. When you submit the reservation form, we collect the name, email address, date, time, number of guests and any special requests you provide. We use this information solely to manage the booking and to contact you about it. Reservation data is retained for twelve months from the date of the booking and is then deleted. We do not use reservation data for marketing and we do not pass it to third parties, except where a service provider processes it on our behalf under a written data processing agreement.

Correspondence. If you write to us by email, we keep your message and our reply for as long as necessary to deal with the matter and for a further two years, after which the correspondence is deleted unless a longer statutory retention period applies.

Server logs. Our hosting provider records the requesting IP address, the time of the request, the page requested, the referring page and the browser identification string. These logs are used to operate and secure the service and are deleted after ninety days. They are not combined with any other data and are not used to identify individual visitors.

Legal basis. Where the GDPR applies, we process reservation data on the basis of the steps necessary to perform a contract at your request, and server log data on the basis of our legitimate interest in operating a secure website.

6. Cookies and local storage

This website does not set advertising or analytics cookies and does not embed third-party tracking scripts. No data about your visit is shared with advertising networks or social media platforms.

The website does not store anything in your browser's local storage or session storage.

7. Your rights

You have the right to ask what personal data we hold about you, to have inaccurate data corrected, to have data deleted where we have no continuing legal basis to keep it, and to object to processing carried out on the basis of our legitimate interests. Where the GDPR applies, you also have the right to receive your data in a portable form and to lodge a complaint with a supervisory authority.

To exercise any of these rights, write to the address given in section 1. We will respond within thirty days. We may ask you to confirm your identity before acting on a request, so that we do not disclose data to the wrong person.

8. Terms of reservation

A reservation submitted through this website is a request, not a confirmed booking. Your table is confirmed only when we send you a confirmation by email or telephone. Where no confirmation is received within two hours of submitting the form, please telephone us rather than assuming the table is held.

Tables are held for fifteen minutes past the reserved time, after which they may be released to other guests. If you are running late, please call and we will hold the table where the evening's bookings allow it. Bookings for seven or more guests are confirmed by telephone in advance and may be subject to a set menu.

Cancellations should be made at least four hours before the reserved time. We do not charge a cancellation fee for standard bookings. For group bookings of ten or more guests, a cancellation made less than twenty-four hours in advance may be charged at EUR 16.00 per person.

Reservations may be made for parties of between one and six guests through this website. Requests for larger parties, private dining and events are handled by telephone so that we can discuss seating and menu arrangements with you directly.

9. Allergen and food information

Allergen information on this website covers the fourteen declarable allergens under EU and Austrian food law and is provided in good faith on the basis of the recipes and supplier declarations in force at the time of publication. Recipes and suppliers can change, and the information here may not reflect the most recent change.

Our kitchen handles gluten, soy, sesame, egg, fish, shellfish, milk and nuts in a single preparation area. We cannot guarantee that any dish is free from traces of an allergen. Guests with a severe allergy should speak to a member of staff before ordering so that the kitchen can advise on what is safe on the day.

Dishes marked as vegetarian contain no meat, fish or shellfish and no fish-derived seasoning. They may contain egg or dairy. Dishes suitable for a vegan diet are identified on request; the kitchen can adapt several vegetarian dishes on the day.

10. Applicable law and jurisdiction

This website, its use and any dispute arising from it are governed by Austrian law, to the exclusion of its conflict of law provisions and of the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Vienna, Austria, subject to any mandatory statutory place of jurisdiction that applies to consumers.

Should any provision of this legal notice be found invalid or unenforceable, the remaining provisions continue in full effect, and the invalid provision is to be replaced by a valid one that comes as close as possible to its commercial purpose.
